If you ever have the need to transfer ownership of your trademark to another entity, you must file the appropriate trademark assignment forms with the USPTO. Situations where this might occur may be somebody has purchased your trademark, or your entire company. Perhaps you simply wish to move the trademark between two companies that you control, or from yourself personally to a company, or visa versa.

In any event, the trademark assignment must be completed properly. If there is any chain of title defect, you run the risk that your federal registration could become worthless! You don’t want that, and neither do we. That’s why we are proud to offer flat fee trademark assignment services. For a flat fee of $500.00, we will provide you with a situational specific trademark assignment agreement sufficient in form to effectuate the transfer. We will also handle appropriate assignment filings with the USPTO. If you already have a sufficient trademark assignment agreement, we are still happy to handle your assignment filings with the USPTO for a flat-fee of just $250.00. These prices include government filing fees for one assignment filing.


Practice Tips

  1. Even if your company changes its name, you should still properly record that assignment with the USPTO.

  2. Any trademark assignment agreement must include the underlying goodwill of the trademark. If not, the prior first-use date and use will not transfer over to the new owner.

  3. Make sure that your trademark assignment agreement includes the right to sue for past infringement!
