The results of a patent search may let you know that your invention was described in one or more patents or patent applications already. If the examining attorney determines that your invention is not, in fact, “new” or “novel”, you can work with your attorneys to see if there is still a viable path to registration. For example, you may need to reorient you patent application to highlight and focus on aspects of the invention that you did not anticipate, or else make improvements on the invention to differentiate it from the prior art.
