Maybe someone is selling knockoffs on Amazon, or a competitor picked a name a little too close to yours. Maybe a letter arrived accusing you of the same. Each has a proportionate response, and we think litigation is the last resort, not the first. One caution: some letters and Board notices carry real deadlines, so send it over rather than sitting on it.

Knockoffs on Amazon this week mean lost sales this week. Amazon, eBay, Etsy, Alibaba, and the like each have a reporting system that works well when your registration is in order and badly when it isn’t. We know which is which, and we can usually get a listing down in days.

Cease-and-desist letters

Most infringers stop when a lawyer asks them to. We write these to be read by the other side’s lawyer, not to make you feel better: firm on the facts, specific on the ask, and careful about what it commits you to. You also get a folder of templates to reuse the next time.

This is how most disputes actually end, and it’s often the best result: a written agreement that draws a clear line between two businesses, costs a fraction of a lawsuit, and lets you get back to work. When that’s the right answer, we’ll tell you so, even though a fight would pay us more.
